Japan’s Liberal Democratic Party (LDP) unveiled a draft bill that would criminalize the act of sharing images or videos of Japanese flag desecration online.

While current laws protect foreign flags to preserve diplomatic ties, this proposal aims to close the gap regarding Japan’s own national symbol, specifically targeting the digital spread of “disrespectful” content.

Proposed Measures

  • Expansion to Digital Media: The bill doesn’t just target the physical act of vandalism; it explicitly includes the posting and distribution of such acts on social media.
  • Stiff Penalties: Violators could face up to two years in prison or a fine of ¥200,000.
  • Threshold for Offense: To qualify for prosecution, the act must be deemed to cause “extreme discomfort” to the public.

Internal Friction and Free Speech

The draft has not yet received a full green light from within the party. Key members have raised concerns that the legislation could infringe upon Article 21 of the Japanese Constitution, which guarantees freedom of expression.

Critics argue that “extreme discomfort” is a subjective standard that could lead to government overreach. To address this, the project team is considering safeguards to ensure that news reporting and legitimate commentary remain protected, focusing the law strictly on those who intentionally promote the desecration.
