Despite having already been elected to the presidency twice, President Trump declined to rule out a bid for a third term, keeping the idea alive by saying, “Am I not ruling it out? I mean, you’ll have to tell me.” This ambiguity fuels excitement among his base, with loyalists like Steve Bannon suggesting that efforts are underway to find a legal “way around” the term limit.

The Constitutional Obstacle: The 22nd Amendment to the U.S. Constitution is the clear barrier here. Ratified after Franklin D. Roosevelt’s four election victories, it explicitly states that “No person shall be elected to the office of the President more than twice.”
Legal Consensus: Most constitutional scholars agree that the language of the 22nd Amendment makes an election bid for a third term legally impossible, predicting any attempt to challenge it in court would fail.

Rejecting the VP Gambit

Supporters had floated an unconventional, “too cute” strategy: Trump would run for Vice President and then assume the presidency if the elected President resigned.

President Trump personally rejected this idea, stating, “I wouldn’t do that. I think it’s too cute… The people wouldn’t like that. It wouldn’t be right.”

The Constitutional Obstacle: Even if he were open to the idea, legal experts dismiss this path due to the 12th Amendment. This amendment states that “no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.” Because the 22nd Amendment makes him ineligible to be elected President, it also makes him ineligible to be elected VP.

In addition to his own speculation, Trump took the opportunity to praise potential 2028 Republican contenders, naming Vice President JD Vance and Secretary of State Marco Rubio as “great people” with strong prospects.
